Terms and Conditions

Please read these terms and conditions (Terms) carefully before registering for an event as they contain important information. By submitting your registration to attend an event (Registration) you agree to be bound by these Terms. If you do not agree to be bound by these Terms we will be unable to accept your Registration.

1. Introduction

We are Future Tech Events Ltd (Company No. 11686680), a company registered in England and Wales with a registered office at 43-45 Promenade Second Floor, Cheltenham, England, GL50 1LE (FTEL).

FTEL acts as an event organiser and these Terms will apply between FTEL and any person, firm, company or other entity who submits a Registration to FTEL and/or who attends the relevant event specified in the Registration (Event). No other Terms will be implied by trade, custom, practice or course of dealing.

2. There may be other terms that apply to you

By agreeing to these Terms you acknowledge that you have read and agree to the terms of our Privacy Policy which can be found [here].

FTEL uses third party services such as Event Create to manage event registrations and ticketing and Stripe for the purposes of payment processing. Other terms and conditions may therefore apply to you when you access and use and these third party services. Please refer to the relevant third parties for details of any applicable terms and conditions.

The Event will be held at a third party venue (the Venue) and therefore the relevant Venue’s terms and conditions will also apply to your Registration. You will agree to be bound by the relevant Venue’s terms and conditions when you attend the Event. Please refer to the relevant Venue for details of any applicable terms and conditions.

Where FTEL links or refers to other sites and resources provided by third parties, this is provided for your information only and should not be interpreted as approval by FTEL of those third parties or the information you may obtain from them.

3. We do not give Business Customers all the same rights as Consumers

Where a term applies just to businesses or just to consumers, this is clearly stated. You are a Business Customer if you are booking the Event in connection with your trade, business, craft or profession, even if you are an individual.

If you are a consumer, these Terms do not and shall not affect your statutory rights as a consumer.

4. Booking

The purchase of tickets is subject to availability and subject to acceptance by FTEL. Your Registration is an offer to FTEL to attend an Event which is subject to FTEL’s acceptance by email. FTEL reserve the right in its sole discretion to refuse to accept your registration and a binding contract between FTEL and you will only be formed when email confirmation of acceptance (Confirmation or Confirmed) is sent by FTEL to you using the contact details you provided at the time of Registration.

You should contact FTEL if you have not received Confirmation within 5 days of your Registration.

5. Pricing

We use our best efforts to ensure that the prices of tickets displayed on our site are correct however it is always possible that, despite our best efforts, some tickets on our site may be incorrectly priced. If we discover an error in the price of a ticket you have ordered, we will contact you to inform you of this error. You will have the option of continuing with the purchase at the correct price or cancelling your order.

If we are unable to contact you using the contact details provided during the registration process we will treat the order as cancelled and notify you of the cancellation.

6. Payment

Subject to paragraph 5 above, prices are as at the date of booking set out on FTEL’s website and you will pay FTEL any fees relating to the Event tickets you are purchasing such as any specified booking fees (your fees). Payment of your fees must be received in full and in cleared funds by FTEL from you at the point of Registration.

Prices for each Event are exclusive of amounts in respect of value added tax (VAT). You shall, on receipt of a valid VAT invoice from FTEL, pay to FTEL such additional amounts in respect of VAT as are chargeable on the supply of the Event.

7. Public Sector Discount

Public sector discounts can only be applied at the time of Registration and discounts cannot be combined. If you register for an Event using the public sector discount you must provide evidence of eligibility for the reduced fee when requested by FTEL or be liable to pay the full fee. All discounts are subject to FTEL’s approval.

8. Cancellations

We reserve the right to reject or cancel your registration if we reasonably think that you do not meet any of our requirements as set out in these Terms or your Confirmation.

9. Receiving your tickets

Your e-ticket will be sent to the email address you provide at the point of Registration.

We aim to send your tickets as soon as possible. If you have not received your tickets 5 days prior to the event, please contact us at info@futuretechevents.com with details of your booking.

10. Changes to your registration

Subject to these Terms, substitutions with employees from your organisation are welcome at any time up to one week prior to the Event but in all other respects delegate registrations are issued for your personal use only and cannot be shared with any person during the Event. You must email details of any required substitutions to info@futuretechevents.com no later than one week prior to the date of the Event. Where your request for a substitution is accepted by FTEL we will email you with confirmation of acceptance. For the avoidance of doubt substitutions are not accepted unless confirmed by FTEL by email.

11. Reselling

You may not purchase tickets as agent for any third party or sell or otherwise transfer your ticket to others, or exploit the registration commercially or non-commercially in any way. Purchasing tickets as or on behalf of a business or trader engaged in the resale of tickets is strictly prohibited.

Tickets sold or being offered for sale for a profit (i.e. above the ticket price) is strictly prohibited.

We reserve the right to cancel such tickets without refund and refuse entry to the event.

Where a restriction applies to the number of tickets that may be purchased and tickets are purchased in excess of this number we may cancel the excess tickets.

12. Changes to the Event

FTEL may (at its sole discretion) change the format, speakers, participants, content, venue location and programme or any other aspect of the Event at any time and for any reason, whether or not due to a Force Majeure Event (in which case the terms of Paragraph 13 shall apply), in each case without liability.

FTEL may (at its sole discretion) change the date or cancel an Event at any time for any reason. Where FTEL changes the date or cancels the Event for any reason, except due to a Force Majeure Event (in which case the terms of Paragraph 12 shall apply), FTEL shall offer you the option of attending any rearranged Event that FTEL chooses to organise (acting in its sole discretion). If you promptly notify FTEL in writing within 14 days of being notified of the changes that you do not wish to attend the rearranged Event, or if FTEL cancels the Event (except due to a Force Majeure Event) then you will (as your sole remedy) be entitled, at our discretion, to receive either a credit note or a refund in respect of your fees received by FTEL for any such rearranged Event not attended by you

It is your responsibility to check that the event is going ahead as staged at the time of your Registration.

13. Force Majeure Event (events outside of our reasonable control)

For the purpose of this Paragraph 13 Force Majeure Event means any event arising that is beyond the reasonable control of FTEL including (without limitation) speaker or participant cancellation or withdrawal, supplier or contractor failure, venue damage or cancellation, health scares, industrial dispute, governmental regulations or action, military action, fire, flood, disaster, civil riot, acts of terrorism or war.

Where a Force Majeure Event has or may have (in FTEL’s sole discretion) an adverse impact on: (i) the ability of FTEL to hold the Event at the planned venue or on the planned date; or (ii) the Event generally, then FTEL shall be entitled but not obliged (in its sole discretion) to either: (i) provide alternative facilities or venue for the Event; and/or (ii) reschedule the Event. We will contact you as soon as possible to let you know of the occurrence of any Force Majeure Event and to let you know about what we can do to prevent or minimise the disruption to the Event. Any of your fees received by FTEL shall be applied to any rearranged or rescheduled Event held pursuant to this Paragraph 13 and, you shall not be entitled to object to such rearranged or rescheduled Event or have any right to claim any compensation in respect thereof.

If FTEL is unable or elects not to rearrange or reschedule the Event pursuant to this Paragraph 13, and as a result the Event is cancelled then you will (as your sole remedy) be entitled, in our sole discretion, to receive either a refund or credit note in respect of your fees received by FTEL, in each case less an administration charge equivalent to the fees incurred by us in performing our contract with you up to the date of cancellation (such as booking administration fees). FTEL may (in its sole discretion) either deduct any such fees from any refund or credit note or invoice them to you separately).

These Terms shall apply in respect of any rearranged or rescheduled Event organised by FTEL pursuant to this Paragraph 12 or 13.

If, by reason of any Force Majeure Event, FTEL is delayed in or prevented from performing any of its obligations under these Terms, then such delay or non-performance shall not be deemed to be a breach of these Terms and no loss or damage shall be claimed by you by reason of the Force Majeure Event.

The provisions of this Paragraph 13 are subject to the provisions of Paragraph 14.

14. Right to a refund – this paragraph applies to Consumers only

If you are a Consumer, you have the statutory right to a refund if we have not performed our services with reasonable care and skill, or our services do not correspond with the information we have given you about them.

15. Event Rules

Please keep your ticket safe as you will be required to produce it to gain entry to the Event. You will also be required to produce your ticket upon request for inspection at any time during the Event and any failure to do so may result in you being ejected from the Event.

Please ensure you arrive to the Event at the stated start time. Whilst we will endeavour to admit latecomers, late admission cannot always be guaranteed.

Admission to the Venue is at all times subject to these Terms. In addition admission to the Event is also subject at all times to the Venue’s terms, conditions and regulations. Amongst other things you will need to present photograph identity documentation when arriving at the Event, and comply with health and safety rules and any security requirements.

Laser pens, dogs (except guide dogs) and food and drink not purchased at the venue may be prohibited and you should check the Venue’s policies on this.

Unless otherwise agreed by us you shall not bring into the Event or display or distribute any sponsorship, promotional or marketing materials.

Abusive, threatening, drunken or other offensive or anti-social behaviour is not permitted during the Event, nor is the carrying of offensive weapons or illegal or prohibited substances.

16. Liability

Nothing in these Terms excludes or limits in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors or for fraud or fraudulent misrepresentation.

If you are a consumer – We shall have no liability beyond the price you have paid for your ticket and shall not be liable for any loss of enjoyment or wasted expenditure. Personal arrangements including travel, subsistence and accommodation relating to the event which have been arranged by you are at your own risk. None of these Terms restrict any of your statutory rights as a consumer.

If you are a Business – To the fullest extent permitted by the applicable law, FTEL excludes: (a) all liability for loss, injury or damage to persons or property at the Event; (b) all indemnities, warranties, representations, terms and conditions (whether express or implied); and (c) any actual or alleged indirect loss or consequential loss howsoever arising suffered by you or any loss of profits, anticipated profits, savings, loss of business revenue, loss of business, loss of opportunity, loss of goodwill, or any other type of economic loss (whether direct or indirect). If FTEL is liable to you for any reason, FTEL’s total liability to you in relation to the Event (whether under these Terms or otherwise) is limited to the amount of ticket fees paid by you and received by FTEL

17. Admission

FTEL may (at its sole discretion) refuse admission to, or eject from the Event, and/or ban from all future events hosted by FTEL, any person in its absolute discretion, including (without limitation) any person who fails to comply with these Terms and the Venue’s terms and conditions or who in the opinion of FTEL represents a security risk, nuisance or annoyance to the running of the Event. You agree to comply with all reasonable instructions issued by FTEL or the venue owners at the Event.

FTEL reserves the right to refuse admission to or eject from the Event any person under the age of 18.

18. Recording

All unauthorised photography and the recording or transmitting of audio or visual material is expressly prohibited. You consent to filming and sound recording and photography of the Event as a delegate and you consent to the use by FTEL of any such recording or photography anywhere in the world for promotional, marketing and other purposes. If you do not wish to be filmed or photographed at the Event please notify us by email to info@futuretechevents.com.

19. Personal Property

Any personal property which you bring to the Event is entirely at your own risk and FTEL accepts no liability for damage, loss or destruction of any personal property.

20. Data Protection

If you are a Business – FTEL and you shall, each at its own expense, ensure that it complies with and assists the other to comply with the requirements of all legislation and regulatory requirements in force from time to time relating to the use of personal data, including (without limitation) any data protection legislation from time to time in force in the UK including without limitation the UK GDPR (which has the meaning given to it in section 3(10) (as supplemented by section 205(4)) of the Data Protection Act 2018); the Data Protection Act 2018; the Privacy and Electronic Communications Regulations 2003 (SI 2003/2426) as amended; and the guidance and codes of practice issued by the Information Commissioner’s Office and which are applicable to a party.

Our Privacy Policy (which can be accessed on our website at [here]) sets out the terms on which we process any personal data which you may provide to us. By submitting your Registration, you accept the terms and conditions of our Privacy Policy and consent to our use of your personal data as described within our Privacy Policy.

21. Complaints

FTEL will endeavour to resolve any problems you experience with us or our services as per our Complaints Policy which can be accessed on our website at [here]. We will endeavour to resolve all complaints in an efficient manner however if we are unable to settle any dispute and you are not satisfied with our final response you may attempt to settle it through alternative dispute resolution. 22. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales.

If you are a Consumer then, wherever you live, you can bring claims against us in the English courts and if you live in Wales, Scotland or Northern Ireland, you can also bring claims against us in the courts of the country you live in. If you are a consumer we can claim against you in the courts of the country you live in.

If you are a Business, any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the English courts. Nothing in this paragraph 21 shall prevent or restrict FTEL from pursuing any action against you in any court of competent jurisdiction.No person other than you and FTEL shall have the right (whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise) to enforce these Terms.

23. Third Parties

No person other than you and FTEL shall have the right (whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise) to enforce these Terms.

24. Amendments

FTEL reserves the right to amend these Terms from time to time by posting a new version on our site. You will be subject to the terms and conditions in force at the time you submit your Registration however any changes to these Terms will apply to any further registrations made after the date the new terms are posted to our site. If you choose to register for further events with us you should check that you have read the latest version of our terms and conditions before registering as you will be agreeing to be bound by them.

25. Transfers

We may transfer our rights and obligations under these Terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under your contract with us.

26. Entire Agreement – this paragraph applies to Business Customers only

These Terms and your Confirmation constitute the entire agreement between you and FTEL and supersede all prior agreements, representations, and understandings between you and FTEL, whether written or oral.

27. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck from these Terms and the remaining provisions shall remain in full force and effect.

28. Waiver

No waiver of any provision of these Terms shall be effective unless in writing and signed by both you and FTEL.

29. Headings

The headings in these Terms are for convenience only and shall not affect their interpretation.
